1. Acceptance of Terms

By accessing or using Dilmune Cloud Services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. These terms constitute a binding legal agreement between you and Dilmune LLC.

2. Description of Service

Dilmune provides cloud hosting and infrastructure management services. We provision and manage servers on third-party cloud providers including DigitalOcean, Hetzner, and Vultr on your behalf. We also support Bring Your Own Server (BYOC), connecting and managing servers on any provider or infrastructure you supply, regardless of where those servers are hosted. Our platform enables you to deploy, manage, and scale web applications through a unified dashboard. The specific features and services available may change from time to time as we continue to improve our platform.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of these terms. You are responsible for safeguarding the authentication methods, sessions, and credentials used to access your account and for all activity that occurs under your account, whether or not you authorized that activity.

4. Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these terms. You agree not to use our services to send spam or unsolicited communications; impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity; interfere with or disrupt the integrity or performance of our services or the data contained therein; or attempt to gain unauthorized access to our services, other accounts, computer systems, or networks connected to our services.

5. Payment Terms

Your platform plan (Free, Builder, or Team) is charged monthly or annually according to your selected billing cycle. The Team plan includes 5 accepted members, including the owner. Each additional accepted member is charged $4 per month on monthly billing or $40 per year on annual billing. Cloud-hosted servers are charged separately at a daily rate for each calendar day the server is active and billed in aggregate at the end of each monthly period. Deleting an on-demand server stops its daily charge from that day forward. BYOC servers carry no separate server charge. Other usage-based or product-specific fees are shown before you incur them. All fees are exclusive of taxes unless stated otherwise. You authorize us to charge your payment method for all fees incurred under your account. Refunds are handled case by case and may be issued within 7 days of the original charge upon request, except where a product-specific checkout or commitment is explicitly stated to be non-refundable. We reserve the right to change our pricing with 30 days prior notice.

6. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these terms. Upon termination, your right to use the services will immediately cease. All provisions of these terms which by their nature should survive termination shall survive, including payment obligations accrued before termination and limitations of liability.

7. Limitation of Liability

In no event shall Dilmune LLC, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services. Our total liability for all claims related to the services shall not exceed the total amount of fees paid by you during the twelve months preceding the claim.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these terms at any time. We will provide at least 30 days notice before any material changes take effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.
